Booking Conditions
Coastal and Country Cottages Ltd (“the Company”) as agents of the property owners (“the Owners”) confirm that the following terms apply between the Owner and the Hirer in respect of every booking confirmed by the Company.
BOOKINGS
- Firm bookings can be made by credit or debit card with a deposit of 30% (thirty per cent) of the rental payable unless the reservation is made within 6 weeks of arrival in which case the full amount is payable. In the event of the Government altering tax rates, relevant to the booking, the Company reserves the right to pass on any increase to the Hirer.
- On receipt of the Company’s confirmation of booking the Hirer should check the details immediately as errors may not be rectified later.
- The Hirer shall not sell or transfer the booking to another party without Coastal and Country Cottages agreement
AUTHORITY TO SIGN
- The person who completes the Booking Form certifies that he or she is authorised to agree the Booking Conditions on behalf of all persons included on the Booking Form, including those substituted or added at a later date; the signatory is over eighteen years of age; they agree to take responsibility for the party occupying the property, and to notify us if they are not a member of that party.
ACCESS
- Unless otherwise advised in writing the property will be available from 3.00 p.m. on the day of arrival and should be vacated and the keys returned no later than 10.00 a.m. on the day of departure otherwise an additional day’s rental may be due. If the Hirer is arriving later than 5.00 p.m. contact must be made with the Company beforehand so that appropriate arrangements can be made as otherwise the Hirer may not be able to obtain access.
- The Company or its representative shall have access to the property at any reasonable time.
OCCUPANCY
- The property must only be used for holiday purposes and the number of occupiers must not exceed the limit specified.
- The Hirer shall not do on the premises, or bring or allow to remain on the premises, anything that may be or become or cause, a nuisance or annoyance, disturbance or inconvenience, injury or damage to the landlord/owner, his tenants or the owners or occupiers of adjacent property or any neighbour’s property.
- The Company reserves the right to take repossession of the property without notice and without refund if the number of occupiers is exceeded or if in the Company’s opinion any party acts in a way which is prejudicial to the well being and comfort of other occupiers or neighbours.
- The Hirer is responsible for keeping the property and its contents in good condition during the period of the let and for leaving the property in a clean and tidy condition. Any damage to the Owner’s property will be the Hirer’s responsibility and should be notified to the Company as soon as possible.
- No furniture, furnishings, bedding or equipment may be taken outside the boundaries of the property.
- Unless otherwise advised in writing the Hirer will be responsible for any excessive use of gas, oil, electricity, water and telephone charges incurred during the let.
- A change of linen is provided between Holidays and weekly during Holidays. Towels and tablecloths are not always provided and Hirer’s should bring their own unless otherwise notified.
DISABILITY
- If the Hirer or occupiers are disabled, checks as to the suitability of the property should be made before booking.
PETS
- Pets are only permitted with the prior consent of Country and Coastal Cottages.
- Where an Owner allows pets the Hirer must at all times keep them under strict control and any damage caused or additional cleaning costs incurred by the Owner will be the Hirer’s responsibility.
- Dogs must never be left unattended at the Property and should be exercised off the premises.
- Dogs should not be allowed in the bedrooms or on the furniture.
CANCELLATIONS
- In the unlikely event of the property becoming unavailable the Company reserves the right to cancel the booking after notifying the Hirer as soon as practicable providing a full explanation and a full refund of monies paid. Neither the Owner nor the Company shall have any liability to the Hirer for damages or consequential losses in the event of such cancellation.
- The Company will endeavour to find alternative accommodation acceptable to the Hirer, but reserves the right to charge any difference in price if the alternative is advertised at a higher price than the original accommodation.
- The Hirer must confirm acceptance of any alternative accommodation offered within 48 hours of being advised of the alteration otherwise the booking will be treated as cancelled and a refund made of monies paid.
OVERSEAS BOOKINGS
- Cancellation insurance does not apply to overseas visitors – please make arrangements to protect your liability.
- Overseas visitors must pay the full rental in advance. Payment by credit card or by international electronic transfer only please.
CHANGING A BOOKING
- If the Hirer wishes to change their reservation once the Company has issued a confirmation reference they must do so in writing as soon as practicable.
PROPERTY DESCRIPTIONS
- The Company makes every effort to ensure that property descriptions are accurate. All the information provided in the brochure or by other means (e.g. the Company’s web site) is believed to be correct at the time of publication and is given in good faith.
WEB SITE DESCRIPTIONS
- Some of the information on the Web site relates to matters beyond the properties such as shops and public houses. Closure of such premises and other changes to external facilities are outside Country and Coastal Cottages’ control. If Country and Coastal Cottages is aware of any material changes to the Web site at the time of the Hirer’s booking, then they shall endeavour to inform the Hirer of these changes.
EQUIPMENT FAILURE
- The Company does not accept liability for problems outside our reasonable control such as breakdowns of domestic appliances, plumbing, etc although the Company will make every effort to rectify problems as soon as possible.
DAMAGE
- The Hirer or other occupiers shall not be entitled to claim against the Company or the Owner in respect of any loss or damage howsoever caused.
COMPLAINTS
- The Hirer must notify the Company as soon as possible of any complaints. The Company is unable to resolve complaints once the Hirer has returned home.
- If Coastal and Country Cottages or the Owners or their representatives are denied the opportunity of investigating the complaint within a reasonable time or denied the opportunity to put matters right during the Holiday, then this may result in a reasonable reduction of any compensation which may be payable to the Hirer arising out of such a complaint.
DATA PROTECTION
- When you book your holiday with us, we collect personal information such as your name, email address, home address, telephone number, credit or debit card number and the card’s expiry date. This allows us to book the property for you. We will also collect non-transactional data should you enter a competition, request a brochure or take part in a survey, for example. We may use the information that we collect to occasionally notify you about news and information we think you may find valuable. For example, we may send you our latest brochure, supplements, newsletters and special offers. If at any stage you decide that you would rather not receive such information, please contact us by telephone, email or post. We employ other companies and individuals to perform functions on our behalf such as sending postal mail, removing repetitive information from lists of our customers, analysing data, providing market assistance and processing credit card payments. We also reveal your identity to the owner of the property you wish to let. Our contractors have access to personal information needed to perform their functions, but may not use it for other purposes.
DISCREPANCIES
- In case of a discrepancy between these Booking Conditions and any other contents of the Country and Coastal Cottages Web site, these Conditions shall prevail, but this shall not limit Country and Coastal Cottages’ liability for failure to supply the accommodation as described on the Web site.
BREACH OF CONTRACT
- If there is a breach of any of these conditions by the Hirer or any of their party, the Owners or Country and Coastal Cottages reserve the right to re-enter the property and end the Holiday and ask the Hirer and their party to leave.
- If there is a breach of any of these conditions by Country and Coastal Cottages or the Owners, then the Hirer has the right to end the Holiday and leave.
- Ending the Holiday by Country and Coastal Cottages, the Owner or the Hirer does not affect that party’s other rights and remedies.
VALIDITY CLAUSE
- In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
GOVERNING LAW AND JURISDICTION
- Any dispute arising from the booking shall be between the Company and the Hirer and dealt with in accordance with English law.
- The tenancy created by this agreement is a Holiday Let within paragraph 9 of Part 1 to Schedule 1 of the Housing Act 1988.
